1. Introduction

This Privacy Policy (the “Privacy Policy”) explains how Amaze Holdings, Inc.’s “Amaze Live”. “Amaze Commerce”, and “Amaze Media” services (“Amaze,” “Amaze Live,” “Amaze Commerce”, “Amaze Media”, “we,” “us”) collects, uses, shares, and protects information about you when you access or use the Amaze platforms and products (the “Service”).

This Privacy Policy applies to information we collect through the Service, including our website, applications, and related features. It does not apply to information collected by third parties, including the third-party retailers (“Merchants”) you may transact with after clicking out of the Service. Their collection and use of your information is governed by their own privacy policies.

By using the Service, you agree to the collection and use of information as described in this Privacy Policy.

By using the Service, you hereby warrant and represent that you have read, understand and agree to this Privacy Policy and the, applicable Terms of Service and that you are over 18 years of age. 2. Information We Collect

Information You Provide to Us. “Personal Information” means information that alone or in combination with other information may be used to readily identify, contact, or locate you. The Personal Information we collect will be different depending on your activities on the Services. For example, to register as a host on Amaze Live, we will collect your date of birth, name, and email address. If you register using a sign-in service or a social media platform such as Google SSO, we will collect the information needed to authenticate your account and any other information the platform provides in that process.

2.1 Information You Provide

We collect information you provide directly when you use the Service, including:

  • Account information: name, display name, email address, password (stored in hashed form), and date of birth (used to verify minimum-age eligibility and to determine whether age-specific features apply).
  • Profile information: any optional profile details you choose to add, such as a profile photo or bio.
  • Content you submit: chat messages, reactions, comments, product designs, videos, posts, “Moments,” and any other content you post on or through the Service. Content posted by hosts during streams using Amaze Live (including video and audio) is also covered.
  • Communications: messages you send to our support team or feedback you submit.
  • Payment information (if applicable): if you subscribe to a paid feature of the Service, billing details are processed by our third-party payment processor [Stripe]. We receive limited transaction information (such as confirmation of payment, last four digits of the payment card, and billing address) but do not store full payment card numbers.

2.2 Information Collected Automatically

When you use the Service, we automatically collect certain technical and usage information, including:

  • Device information: device type, operating system, browser type and version, device identifiers, screen resolution, and language settings.
  • Connection information: IP address, internet service provider, and approximate geographic location derived from your IP address.
  • Usage information: the streams you view, the duration of your viewing, the chat messages you send or react to, the products you click on, your order history (exclusive of payment information provided to our third-party payment processor), the features you use, the dates and times you access the Service, and pages or screens you visit.
  • Click-out information: when you click a product link in a stream or on a storefront, we record the click. We do not, by default, receive information from the destination Merchant about whether you completed a purchase or how much you spent.
  • Cookies and similar technologies: see Section 5 for details.

2.3 Information from Third Parties

We may receive information about you from third parties, including:

  • Sign-in providers: if you choose to create an account or sign in using a third-party identity provider (such as Google), that provider shares basic profile information with us (typically name, email address, and profile image). We do not receive your password from these providers.
  • Service providers: vendors that help us operate the Service may provide us with information collected on our behalf, such as analytics data and security threat intelligence.

Amaze Tools. “Performance Information” means information we collect through certain tools that we provide to our sellers. Where a seller requests the use of a particular tool (e.g. an advertising analytics tool for use with ad platforms), then Amaze will collect additional data based on the operation of that tool (e.g. advertising conversion information from the applicable ad platform).

Blog. The Service may offer publicly accessible blogs or community forums. You should be aware that any information you provide in these areas may be read, collected, and used by others who access them. To request removal of your personal information from our blog or community forum, contact us at privacy@amaze.co In some cases, we may not be able to remove your Personal Information, in which case we will let you know if we are unable to do so and why.

Social Media Widgets. The Service may include social media features, such as the Facebook like button and share buttons. These features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the features to function properly. Certain social media features are hosted by the applicable provider (e.g. Facebook). Your interactions with these features are governed by the privacy policy of the company providing the features.

Single Sign-On. You may be able to log into the Service using sign-in services such as Facebook Connect or an Open ID provider. These services will authenticate your identity and provide you the option to share certain Personal Information with us such as your name and email address to pre-populate our sign up form. Services like Facebook Connect give you the option to post information about your activities on the Services to your profile page to share with others within your network.

3. How We Use Information

We use information collected through the Service to:

  • provide, operate, and maintain the Service, including authentication, content delivery, and customer support;
  • personalize your experience, including recommending streams and content;
  • communicate with you about the Service, including service announcements, security alerts, and (where you have opted in) marketing communications;
  • verify your eligibility to use the Service, including age verification and compliance with sanctions screening;
  • monitor for, prevent, and respond to fraud, abuse, and security incidents;
  • analyze usage to improve, develop, and test new features;
  • comply with legal obligations and respond to lawful requests from public authorities;
  • enforce our Terms of Service and Community Guidelines; and
  • with your consent, for any other purpose disclosed at the time of collection.

If you wish to subscribe to our newsletter(s), we will use your name and email address to send the newsletter to you. You may choose to stop receiving our newsletter or marketing emails by following the unsubscribe instructions included in these emails, accessing the email preferences in your account settings page or you can contact us at privacy@amaze.co. You may not opt-out of the transactional emails Amaze sends in connection with your use of the Services (e.g. email notification of individual account activity, such as shipment of an order, or broader account notifications such as changes to Amaze’s policies).

We partner with a third party to either display advertising on our website or to manage our advertising on other sites. Our third party partner may use technologies such as cookies to gather information about your activities on this website and other sites in order to provide you advertising based upon your browsing activities and interests. If you wish to not have this information used for the purpose of serving you interest-based ads, you may opt-out by clicking here.

We use Performance Information to analyze and better understand the characteristics of successful offerings and campaigns and to improve the performance of our sellers and the overall Service.

Amaze processes Personal Information in the United States. Please note that you are agreeing to the transfer of your Personal Information to the United States and other locations throughout the world. Your Personal Information will be processed in accordance with this Privacy Policy.

We may use your content to train AI models and provide AI based features and functionality to the platform.

4. How We Share Information

We share information in the following circumstances:

4.1 Service Providers

We share information with vendors who provide services on our behalf, such as cloud hosting, payment processing, analytics, email delivery, customer support, content moderation, and fraud prevention. These providers are contractually limited to using your information only as needed to perform their services for us.

4.2 Hosts on Amaze Live

Hosts on Amaze Live can see chat messages and reactions you contribute to their streams in real time. If a stream is recorded, your participation may be visible in any replay or distributed copy. Hosts do not have access to your account email, IP address, or other private account details.

4.3 Third-Party Retailers

When you click a product link in a stream or elsewhere on the Platform, you are directed to the Merchant’s site. We share with the Merchant the information necessary to deliver you to that destination, which may include a referral identifier. The Merchant’s collection and use of your information after the click is governed by the Merchant’s own privacy policy. 

4.4 Affiliates

We may share your personal information with our corporate affiliates, including our parent company, subsidiaries, and entities under common ownership or control with Amaze. These affiliates may use your personal information for the purposes described in this Privacy Policy, including to provide and improve our products and services, deliver customer support, conduct internal analytics and research, personalize your experience, and for marketing and promotional communications (where permitted by law). All affiliates are required to handle your personal information in a manner consistent with this Privacy Policy and applicable data protection laws. 

4.5 Other Users

Some information you provide is visible to other users by design. Your display name, profile photo, and any chat messages or reactions you post in a stream are visible to other viewers and to the host. Choose what you share accordingly.

4.6 Legal and Safety

In certain situations, Amaze may be required to disclose Personal Information in response to lawful requests by public authorities, including meeting law enforcement requirements. We may access, preserve, and disclose your Personal Information and content if we believe doing so is required or appropriate to comply with law enforcement requests, such as a court order or subpoena, bankruptcy proceedings, or similar legal process or when we believe in good faith that disclosure is necessary to protect our rights or the rights of others. Specifically, we may disclose your information to a complainant who alleges that your activities have violated their rights or policies (e.g. where your product, design, campaign or advertisement is the subject of an investigation). We may also disclose your information where you have alleged violation of your rights by another party.

4.7 Corporate Transactions

If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, your information may be transferred as part of that transaction. You will be notified via email and/or a prominent notice on our website, of any change in ownership, uses of your personal information, and choices you may have regarding your personal information.

We may also disclose your personal information to any other third party with your prior consent.  All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

4.8 With Your Consent

We may share information for other purposes with your consent or at your direction.

4.9 AI Training. We may share your content to train AI models and provide AI-based features and functionality to the Services.  

4.10 Sale of Your Personal Information

We may sell or share your Personal Information with third parties for monetary or other valuable consideration, as those terms are defined under applicable U.S. state privacy laws, including the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA). We sell or share the categories of Personal Information described in the “Personal Information We Collect” section of this Privacy Policy to the categories of third parties described in the “How We Disclose Personal Information” section for the purposes described there. Residents of certain U.S. states have the right to opt out of the sale or sharing of their Personal Information. You may exercise this right at any time by using our “Do Not Sell or Share My Personal Information” link (where available) or by following the instructions in the “Your Privacy Rights” section below, and we will honor your request as required by applicable law.

4.11 Strategic Partners

We may share aggregate, anonymized data with certain marketing and content licensing partners. Where a partner or agency compensates sellers directly, we will also share performance data with the partner to enable those payments.

5. Cookies and Similar Technologies

We, Amaze, and our partners use technologies such as cookies or similar technologies to analyze trends, administer the website, track users’ movements around the website, and to gather demographic information about our user base as a whole. We also use cookies, to remember users’ settings (e.g. language preference), for authentication and other similar services. Users can control the use of cookies at the individual browser level. If you reject cookies, you may still use our site, but your ability to use some features or areas of the Service may be limited.

5.1 What We Use. We use cookies, web beacons, pixel tags, local storage, and similar technologies (collectively, “cookies”) to operate the Service, remember your preferences, analyze usage, and (where applicable) deliver and measure marketing.

5.2 Categories. Cookies on the Service fall into the following categories:

  • Strictly necessary: required to operate the Service, including authentication, security, and basic functionality. These cannot be disabled.
  • Analytics: help us understand how the Service is used so we can improve it.
  • Functionality: remember your preferences (e.g., language, display options).
  • Marketing: if used, help us measure the effectiveness of marketing campaigns and (in some cases) deliver targeted advertising.

5.3 Your Choices. When you first visit the Service, we present a cookie preferences banner that lets you accept or reject non-essential cookies during your visit.

5.4 Browser-Based Signals. We honor opt-out preference signals sent by your browser, such as Global Privacy Control (GPC), where required by applicable law. We do not currently respond to “Do Not Track” signals because there is no consensus standard for how to interpret them.

6. Amaze Live Streams, Chat, and Recordings

6.1 Public Visibility. Streams on Amaze Live are visible to other viewers in real time. Chat messages, reactions, and other interactions you contribute to a stream are visible to the host and to other viewers in that stream.

6.2 Recording is Host-Controlled. Hosts may, at their option, choose to have their stream recorded. When a stream is being recorded, a visual indicator is displayed in the stream interface.

6.3 What Recordings May Capture. A recording may capture the host’s audio and video, the products and links displayed during the stream, viewer chat messages, viewer display names, viewer reactions, and the order in which contributions occurred.

6.4 Use of Recordings. Recordings may be replayed on the Service, embedded in other content on the Service, used to train automated content-moderation systems, and otherwise used as described in our Terms of Service.

6.5 Limits on Removal. Once a stream is recorded, individual contributions may not be removable from the recording without removing the recording itself. We will use commercially reasonable efforts to honor specific deletion requests where feasible.

7. Your Choices and Controls

7.1 Access and Update. You can access and update your account information at any time through your account settings. Some information is required to operate the Service and cannot be removed without closing your account.

7.2 Account Deletion. You can delete your account at any time through your account settings, or by contacting us at privacy@amaze.co. After deletion, we may retain certain information as required by law, for legitimate business purposes (such as fraud prevention), or where information has been incorporated into recordings or other users’ content.

7.3 Communications Preferences. You can opt out of marketing emails by following the unsubscribe instructions in any marketing email or by adjusting your account communication settings. We may continue to send you transactional and service-related communications (for example, security alerts and account notices) regardless of your marketing preferences.

7.4 Cookies. Manage cookie preferences as described in Section 5.

7.5 Push and In-App Notifications. If our applications send push notifications, you can control them through your device settings.

8. Data Retention

We retain personal information for as long as necessary to provide the Service, comply with our legal obligations, resolve disputes, and enforce our agreements. Retention varies by data type:

  • Account information: retained while your account is active, plus a reasonable period after deletion for backup, fraud prevention, and dispute resolution.
  • Chat messages and reactions: retained for the duration of the relevant stream and any associated recording.
  • Recordings: retained according to host settings and our retention practices.
  • Logs and analytics: retained for a limited period in identifiable form, then aggregated or deleted.
  • Information required by law: retained for the period required by applicable law, regardless of the foregoing.

9. Security

We use commercially reasonable administrative, technical, and physical safeguards designed to protect personal information against loss, misuse, unauthorized access, disclosure, alteration, and destruction. No system is perfectly secure. We cannot guarantee the security of your information, and you transmit information to us at your own risk.

If we become aware of a security incident affecting your information, we will notify you and applicable authorities as required by law.

10. Children’s Privacy

10.1 Minimum Age. The Service is not directed to children. We do not knowingly collect personal information from anyone under 18.

10.2 If We Discover an Underage User. If we learn that we have collected personal information from a person under 18, we will terminate the account and delete the associated information consistent with applicable law. If you believe someone under 18 may have provided personal information through the Service, please contact us at privacy@amaze.co.

11. International Users and Data Transfers

The Service is operated from the United States. Information we collect is processed in the United States and other countries where our service providers operate. If you access the Service from outside the United States, you understand that your information will be transferred to and processed in the United States, which may have data-protection laws different from those in your country.

What You Can Expect From Us. Access personal data

Request access to your personal data (commonly known as a "data subject access request"). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.
